Guarantee and Spay / Neuter Contract
This agreement made
this _____ day of _______________, ______ , between Kimberly Thorwart d/b/a Patchwork Shepherds, hereinafter referred to as Seller, and ________________________________ hereinafter known as Buyer.
SECTION I.
DESCRIPTION OF ANIMAL/PAYMENT
For the sum of $_______, the receipt of which is hereby acknowledge, Seller
hereby sells and conveys to Buyer, or his/her order, the following described canine:

Registration
papers will be held until paid in full and checks clear.
With payments, checks must be made with date of payments on them
before dog is taken.
If any check does not clear on that date, dog can be repossessed.
Deposit non-refundable, all sales
are final.
SECTION II.
HEALTH
The purchase price shall include the following
vaccinations:

Buyer acknowledges that this dog is delivered by Seller in a healthy condition.
Seller has no control over this dog’s environment after acceptance by Buyer and therefore does not guarantee continued
good health. Buyer agrees to have the dog examined by a licensed veterinarian within 72 hours of acceptance to certify such
health, thereby relieving Seller of any and all claims. Seller is not responsible
for Buyer’s vet expense.
Seller guarantees against moderate or severe hip dysplasia (HD) for 36 months based
upon an Orthopedic Foundation for Animals (OFA) certificate. If you purchased a Pet Quality puppy and the puppy in unable
to live a normal pet life due to discomfort from a genetic condition you will be given a replacement puppy of equal value.
No guarantees if cause is accidental or brought on by owner negligence.
SECTION III.
CARE
The Buyer promises to provide responsible care for this dog/puppy by
providing proper nutrition, sanitary facilities, annual vaccinations, regular veterinary attention and including protection
from hazards such as traffic, other animals ect. The dog/puppy will be kept indoors unless a safe outdoor enclosure is
provided.
SECTION IV.
SPAY/NEUTER
Buyer agrees that this canine
will not be used for breeding. All “pet” quality will be spayed or neutered by one year. Limited registration
will be checked.
SECTION V.
RESALE-REPOSSESSION
The Buyer agrees to notify Seller if he/she cannot or will not care for said
dog/puppy any further. Said dog/puppy is to be returned to Patchwork Shepherds and under NO circumstances is the dog/puppy
to go to a new home without Patchwork Shepherds being notified and agreeing to it. If shipping is required to return
the canine Patchwork Shepherds will pay for and make shipping arrangements. The dog may be given away if, it is
to a family relative/friend and if the Buyer and Seller agree that this is in the canine’s best interest. Under no circumstances
will this canine be sold, leased, or given to any pet shop, research laboratory, or similar facility. This contract/guarantee
will not be honored if Patchwork Shepherds has not been notified of new ownership. If
said dog needs to be found a new home then a new contract/guarantee will be drawn up with new owners signature. Seller reserves that right to repossess this canine in the event the Buyer fails or refuses to comply with
any or all of the terms of this agreement. Cost of enforcing compliance will be born by the Buyer.
SECTION VI.
ENTIRE AGREEMENT
This agreement supersedes all others, either oral or in writing between the
parties with respect to the purchase and sale of the above described canine and contains all of the covenants and understandings
between the parties with respect to said subject.
Any modification or change to this agreement must be agreed upon in
writing by both Buyer and Seller.
SECTION VII.
SEVERABILITY
If any portion of this agreement is declared invalid, any remaining portion
shall remain in force and effect as if it had been executed with the invalid portion eliminated. It is the intention of the
parties that they would have executed this agreement without including any such portion, which may, for any reason be declared
invalid.
SECTION VIII.
GOVERNING LAW
It is agreed by the Buyer and Seller that this agreement shall be deemed
to have made and to be performable in the County of Pierce, State of Washington,
and shall be governed by and resolved on accordance with the laws of the State of Washington.
SECTION IX.
ATTORNEY FEES
In the event either
the Buyer or Seller shall bring any action in connection with this agreement, the prevailing party shall be entitled to recover
as part of such action reasonable attorney fees and cost.
In witness whereof, the parties have executed this agreement
on the day and year first written.
