Guarantee and Breeding Contract

      This agreement made this _____ day of _______________, ______ ,  between Matthew and Kimberly Lantz d/b/a Patchwork Shepherds, hereinafter referred to as Seller, and ________________________________ hereinafter known as Buyer.

SECTION I.  DESCRIPTION OF ANIMAL/PAYMENT

For the sum of $_______, the receipt of which is hereby acknowledge, Seller hereby sells and conveys to Buyer, or his/her order, the following described canine:

Registration papers will be held until paid in full and checks clear.
With payments, checks must be made with date of payments on them before dog is taken.
If any check does not clear on that date, dog can be repossessed.
Deposit non-refundable, all sales are final.

SECTION II. HEALTH

The purchase price shall include the following vaccinations:
Puppy Shot_____ Puppy Booster_____ First Adult_____ Second Adult_____
A separate health record with dates will be furnished. Now: _____  Later: _____
Buyer acknowledges that this dog is delivered in a healthy condition. Seller has no control over this dog’s environment after acceptance by Buyer and therefore does not guarantee continued good health. Buyer agrees to have the dog examined by a licensed veterinarian within 72 hours of acceptance to certify such health, thereby relieving Seller      of any and all claims. Seller is not responsible for Buyer’s vet expense.
Seller guarantees against hip dysplasia (HD) and all genetic health issues,  for 48 months based upon an Orthopedic Foundation for Animals (OFA) certificate or Preliminary Report.  If health problems arise within that period of time you must present proof from a liscensed veterinarian.  No guarantee if cause is accidental or brought on by owner negligence.

SECTION III. CARE

The Buyer promises to provide responsible care for this dog by providing proper nutrition, sanitary facilities, annual vaccinations, regular veterinary attention and including protection from hazards such as traffic, other animals ect. The canine will be kept indoors unless a safe outdoor enclosure is provided.

SECTION IV. BREEDING

All breeding dogs will be two years of age, titled in either Conformation and/or Obedience,  OFA’d, free of skin allergies and any unwanted traits that are not of the GSDCA or SV breed standards, before any breeding takes place. All co-owned dogs will be cared for physically and financially by the buyer of such said dog. Any further comments to this agreement will be filled in and signed by both parties in section X.

SECTION V. RESALE-REPOSSESSION

The Buyer agrees to notify Seller if he/she cannot or will not care for this canine any further, and agrees to give Patchwork Shepherds first option to get said puppy/dog back.   Under no circumstances will this dog be sold, leased, or given to any pet shop, research laboratory or similar facility. If said dog is sold or given away without our being notified and agreeing contract/guarantee is void. If dog/puppy is rehomed a new contract/guarantee will  be drawn up for the new owners.  Contract is NOT TRANSFERABLE.  Seller reserves that right to repossess this dog in the event the Buyer fails or refuses to comply with any or all of the terms of this agreement. Cost of enforcing compliance will be born by the Buyer.

SECTION VI. ENTIRE AGREEMENT

This agreement supersedes all others, either oral or in writing between the parties with respect to the purchase and sale of the above described canine and contains all of the covenants and understandings between the parties with respect to said subject.
Any modification or change to this agreement must be agreed upon in writing by both Buyer and Seller.

SECTION VII. SEVERABILITY

If any portion of this agreement is declared invalid, any remaining portion shall remain in force and effect as if it had been executed with the invalid portion eliminated. It is the intention of the parties that they would have executed this agreement without including any such portion, which may, for any reason be declared invalid.

SECTION VIII. GOVERNING LAW

It is agreed by the Buyer and Seller that this agreement shall be deemed to have made and to be performable in the County of Pierce, State of Washington, and shall be governed by and resolved on accordance with the laws of the State of Washington.

SECTION IX. ATTORNEY FEES

In the event either the Buyer or Seller shall bring any action in connection with this agreement, the prevailing party shall be entitled to recover as part of such action reasonable attorney fees and cost.

SECTION X. SPECIFICS TO BREEDING

As per this contract, owner will raise such said dog. By 2 years of age, dog shall be titled in conformation and/or obedience. Dog will be OFA’d for hips and elbows. Dog will be cleared of all unwanted traits that are not of the GSDCA or SV breed standards.

All expenses for care, titling, transportation, and typical ownership will be bared by owner.

We have selectively bred our puppies with the expectations that they will live long and healthy lives. Should your dog experience any serious health problems or accidents, we would greatly appreciate being promptly advised of the situation and its resolution.
